Please read these terms carefully to ensure a clear understanding of our policies. By booking our services, you agree to the following Terms of Service.


1. Services Provided


Ocean West Studio provides photography and videography services. Our commitment is to capture and preserve your special moments in a professional manner.


2. Delivery Timeline


Edited Photos: The timeline for editing photos will begin on the next business day after the shoot and the timeline for delivering the edited photos will be 7-45 business days, depending on the shoot and how many photos were captured.



Highlight Film: Editing of the Highlight Film will start once the Client confirms the song choices in writing. The delivery timeline will start from the date of this confirmation.


3. Consistency and Style


3.1 Consistency: Ocean West Studio will use reasonable efforts to ensure that the services are produced in a style consistent with our current portfolio. We will consult with the Client and incorporate any reasonable suggestions.


3.2 Style Acknowledgment: The Client acknowledges and agrees that:

  • The Client has reviewed Ocean West Studio's previous work and portfolio and has a reasonable expectation that the services will be performed in a similar style.
  • Disagreement with Ocean West Studio’s aesthetic judgment or artistic ability are not valid reasons for termination of this Agreement or requests for refunds.
  • Ocean West Studio retains the final say regarding aesthetic judgment and artistic quality of the services provided.


4. Client Responsibilities


4.1 Harassment by Client or Guests: The Client agrees to ensure that all attendees conduct themselves in a respectful and non-harassing manner toward Ocean West Studio's staff. If any staff member experiences harassment or threatening behavior from the Client or Client's guests, Ocean West Studio reserves the right to cease providing services and leave the location without obligation for refund or additional compensation. The Client remains responsible for payment any remaining fees.


4.2 Responsibility for Guest Behavior: The Client acknowledges responsibility for the behavior of all attendees and agrees to ensure that all guests comply with reasonable requests from Ocean West Studio to facilitate service completion. In the event of harassment or inappropriate behavior towards Ocean West Studio's staff by the Client’s guests, Ocean West Studio may, at its discretion, suspend or terminate services. The Client will remain liable for full payment of fees and expenses under this Agreement without entitlement to refunds or additional compensation.


4.3 Immediate Action for Harassment: Upon encountering harassment or inappropriate behavior, Ocean West Studio will promptly notify the Client. The Client agrees to take immediate action to resolve the issue. If harassment persists or escalates, Ocean West Studio may terminate services, and the Client will remain liable for all fees and expenses due under this Agreement, without entitlement to refunds or additional compensation.


5. Ownership of Work Product


5.1 Ownership Rights: Ocean West Studio will own all rights, title, and interest in all photos and video captured or recorded during the event or shoot ("Work Product"). The Client (on behalf of itself and any attendees at the event) hereby grants Ocean West Studio and any of its service providers an exclusive, royalty-free, worldwide, irrevocable, transferable, and sublicensable license to use any materials created by Ocean West Studio, the Client, or attendees during the performance of the services that may be protected by copyright or any intellectual property rights as part of any work product or in connection with the marketing, advertising, or promotion of Ocean West Studio's services, including but not limited to the studio, portfolio, advertising, website, or social media, in any format or medium. The Client acknowledges that no other person or entity has any rights that may prevent or restrict Ocean West Studio from using work product or event materials as provided herein.


6. Model Release


The Client grants Ocean West Studio the unrestricted right and permission to use, reproduce, publish, and distribute photographs and videos taken during any event or shoot for any purpose, including but not limited to advertising, marketing, and promotional materials, in any medium. This grant includes the right to edit, alter, or modify the images or videos as Ocean West Studio sees fit. The Client acknowledges that they do not require compensation for the use of these images or videos and releases Ocean West Studio from any liability related to the use of the Work Product.


9. Liability for Damaged Equipment


The Client acknowledges that they are fully responsible for any damage caused to Ocean West Studio's equipment by the Client or their guests during the event or shoot. In the event of any damage to Ocean West Studio's equipment, the Client agrees to compensate Ocean West Studio for the retail value of the damaged equipment, as determined by Ocean West Studio.


10. Amendments


We reserve the right to amend these Terms of Service at any time. Any changes will be effective immediately upon posting on our website. We encourage you to review these terms periodically for updates.

Cancellation


Messages will provide instructions to unsubscribe either by texting STOP or through an included link. After you unsubscribe, we will send you a message to confirm that you have been unsubscribed and no more messages will be sent. If you would like to receive messages from Ocean West Studio again, just sign up as you did the first time and Ocean West Studio will start sending messages to you again.

The duty to inform us based on the above events is a condition of using this service to receive messages.
